HAMBE Central Executive Board: Agrarian reform must respect the history, customs, and rights of the Negeri Langkat Sultanate
The Central Executive Board of the United Malay Advocates Association (DPP HAMBE) has expressed critical views regarding agrarian reform policies—specifically provisions within the agrarian reform bill that have the potential to disregard or nullify rights rooted in the history, customs, and legal ties associated with the Negeri Langkat Sultanate.
DPP HAMBE General Chairman Ariffani, S.H., M.H., emphasized that, in principle, agrarian reform should aim to provide justice, legal certainty, and an equitable distribution of land ownership and usage—rather than erasing historical traces or ignoring the rights of indigenous communities and the Sultanate institution, which holds a long-standing history in the region.

“HAMBE supports the spirit of land reform as long as its goal is justice. However, if a regulation disregards or excludes the historical rights of the Negeri Langkat Sultanate, it must undergo serious revision and cannot simply be accepted,” stated Ariffani, S.H., M.H., Chairman of the HAMBE Central Executive Board, in an email received on Saturday, September 12, 2026.
According to HAMBE, agrarian issues in Langkat cannot be viewed solely through the lens of modern land management. Factors such as the history of land ownership, concessions, the Sultanate’s relationship with the community, customary rights, and existing legal documents and evidence must first be objectively verified.
Therefore, any change in land policy must avoid an approach that “erases the past to solve today’s problems.” Instead, history must be incorporated into the verification process to establish the status of the land and the legal relationship with it.
HAMBE also maintains that if historical claims or rights exist, they must be resolved through archival research, document verification, land mapping, investigation of ownership history, and transparent legal mechanisms, with proportionate stakeholder involvement.

“Land reform must not become a ‘historical reform.’ Land can be organized and administration improved, but history and legally proven rights must not be erased,” stated HAMBE.
HAMBE urges the government and the House of Representatives
The Central Executive Board (DPP) of HAMBE requests that deliberations on the land reform bill be conducted according to the following principles:
1. Respect for the constitutional rights of communities and indigenous peoples.
2. Recognition of the importance of historical land ownership and management in the land verification process.
3. Conducting an inventory and verification of lands associated with the Negeri Langkat Sultanate.
4. Refraining from abolishing rights solely on the basis of changes in administration or legal designation.
5. Creating space for the participation of the Malay community and stakeholders associated with the Negeri Langkat Sultanate.
6. Ensuring legal certainty and a fair, transparent dispute resolution mechanism. HAMBE emphasized that the position “Reject the land reform bill if it infringes upon the historical rights of the Langkat Sultanate” is not a rejection of land reform as a concept, but rather a warning that the land reform agenda must not be implemented at the expense of rights grounded in history and law. ***rel
DPP HAMBE: Reforma Agraria Harus Menghormati Sejarah, Adat, dan Hak Kesultanan Negeri Langkat
Dewan Pimpinan Pusat Himpunan Advokat Melayu Bersatu (DPP HAMBE) menyampaikan sikap kritis terhadap setiap kebijakan reforma agraria, khususnya apabila terdapat ketentuan dalam RUU Reforma Agraria yang berpotensi mengabaikan atau menghilangkan hak-hak yang memiliki dasar sejarah, adat, dan hubungan hukum dengan Kesultanan Negeri Langkat.
Ketua Umum DPP HAMBE, Ariffani, S.H., M.H., menegaskan bahwa reforma agraria pada prinsipnya harus diarahkan untuk menghadirkan keadilan, kepastian hukum, serta pemerataan penguasaan dan pemanfaatan tanah — bukan justru menghapus jejak sejarah atau mengabaikan hak masyarakat adat dan institusi Kesultanan yang memiliki sejarah panjang di suatu wilayah.
“HAMBE mendukung semangat reforma agraria sepanjang tujuannya menghadirkan keadilan. Tetapi apabila sebuah regulasi justru menghilangkan atau mengabaikan hak kesejarahan Kesultanan Negeri Langkat, maka hal tersebut harus dikaji secara serius dan tidak boleh diterima begitu saja,” kata Ariffani, S.H., M.H., Ketua Umum DPP HAMBE dalam pesan elektronik yang diterima, Sabtu, 12 September 2026.
Menurut HAMBE, persoalan agraria di Langkat tidak dapat dilihat semata-mata dari perspektif administrasi pertanahan modern. Sejarah penguasaan tanah, konsesi, hubungan Kesultanan dengan masyarakat, hak-hak adat, serta dokumen dan bukti hukum yang masih ada harus terlebih dahulu diverifikasi secara objektif.
Karena itu, setiap perubahan kebijakan pertanahan harus menghindari pendekatan yang bersifat “menghapus masa lalu demi menyelesaikan persoalan hari ini.” Sebaliknya, sejarah harus dijadikan bagian dari proses verifikasi untuk menentukan status dan hubungan hukum atas tanah.
HAMBE juga berpandangan bahwa apabila terdapat klaim atau hak kesejarahan, penyelesaiannya harus dilakukan melalui penelitian arsip, verifikasi dokumen, pemetaan tanah, pemeriksaan riwayat penguasaan, serta mekanisme hukum yang transparan, dengan melibatkan pihak-pihak yang memiliki kepentingan secara proporsional.
“Jangan sampai reforma agraria berubah menjadi reforma sejarah. Tanah boleh ditata, administrasi boleh diperbaiki, tetapi sejarah dan hak yang terbukti secara hukum tidak boleh dihapuskan,” sebutnya.
HAMBE Mendorong Pemerintah dan DPR
DPP HAMBE meminta agar pembahasan RUU Reforma Agraria dilakukan dengan prinsip:
1. Menghormati hak-hak konstitusional masyarakat dan masyarakat adat.
2. Mengakui pentingnya sejarah penguasaan dan pengelolaan tanah dalam proses verifikasi agraria.
3. Melakukan inventarisasi dan verifikasi terhadap tanah-tanah yang memiliki hubungan dengan Kesultanan Negeri Langkat.
4. Tidak melakukan penghapusan hak hanya berdasarkan perubahan administrasi atau nomenklatur hukum.
5. Membuka ruang partisipasi masyarakat Melayu dan para pemangku kepentingan Kesultanan Negeri Langkat.
6. Menjamin kepastian hukum serta mekanisme penyelesaian sengketa yang adil dan transparan.
HAMBE menegaskan bahwa sikap “Tolak RUU Reforma Agraria jika menghilangkan hak kesejarahan Kesultanan Negeri Langkat” bukanlah penolakan terhadap reforma agraria sebagai gagasan, melainkan peringatan agar agenda pembaruan agraria tidak dilakukan dengan mengorbankan hak yang memiliki dasar sejarah dan hukum. ***rel
