Complaints about Eid al-Fitr Allowance (THR) opened


The provincial government of North Sumatra (Pemprov), through the Labor Affairs Bureau (Disnaker), reminds all private companies to pay the Eid al-Fitr Allowance (THR) to their employees no later than seven days before Eid al-Fitr.

Compliance with this provision is mandatory under current regulations. Companies that fail to comply with these obligations may be subject to sanctions and fines.

“Currently, the provisions for providing holiday allowance (THR) still refer to Regulation No. 6 of 2016 of the Minister of Labor concerning allowances for religious holidays for employees or workers in companies. This regulation clearly states that the company is obligated to pay the THR,” said Yuliani Siregar, head of the North Sumatra Labor Office, on Tuesday, March 3, 2026.


Companies must pay the THR for Eid al-Fitr in the form of a monthly salary/wage


She explained that the THR that companies are obligated to pay is equal to a monthly salary, consisting of wages without allowances (net wages) or basic wages including fixed allowances.

“Employers are obligated to provide the THR for religious holidays to employees or workers who have been employed continuously for at least one month,” Yuliani said.

Employees who have been employed continuously for twelve months or more are entitled to the THR in the form of a monthly salary. Meanwhile, employees with a service period of at least one month but less than twelve months receive a holiday allowance (THR) prorated to their length of service.

“The calculation is based on the length of service multiplied by the monthly salary, and then divided by twelve. However, if the length of service is less than one month, the employee is not eligible for the holiday allowance,” Yuliani explained.


Late payment of holiday allowance may result in fines and administrative sanctions


According to Ministry of Labor regulations, employers who are late in paying the holiday allowance may be fined 5 percent of the total amount due.

This fine is administered and used for the well-being of employees, in accordance with company regulations or collective bargaining agreements. In addition to fines, employers who are late in paying the holiday allowance may also be subject to administrative sanctions in accordance with legal provisions.

To ensure that THR payments are made in accordance with regulations, the Ministry of Labor has mandated the establishment of THR complaint centers in all regions, including North Sumatra.

Yuliani stated that complaints can be filed online through the official website of the Ministry of Labor: poskothr.kemnaker.go.id. In addition, the North Sumatra Labor Affairs Bureau has also opened its own complaint center.

“We will appoint an administrator to handle THR complaints, specifically in North Sumatra. In addition, the Provincial Labor Affairs Bureau and the six existing Technical Implementation Units (UPTs) will also establish complaint centers in their respective areas,” he said.

Every report received will be immediately followed up by labor inspectors. If a company is found to have not paid the THR according to regulations, an on-site inspection will be conducted.

“We will respond to every complaint immediately and monitor it closely. Labor inspectors will directly inspect companies that do not pay the THR (Disability Tax) to determine the cause,” he emphasized.

Yuliani hopes that all companies will adhere to the THR payment rules, so that harmonious labor relations in North Sumatra can be maintained and the rights of workers can be guaranteed in view of religious holidays. ***rel
